Unfortunately, No Domestic Violence Act For Husbands: Madras HC

The Madras High Court made notable comments that it is unfortunate that there is no Domestic Violence Act for husbands against wives in marital cases.

Justice S Vaidyanathan made these comments which garnered a wider attention and he made the above remarks while hearing a case of a veterinary doctor by name Dr. P Sasikumar. The doctor was removed from his government job based on a complaint filed by his ex-wife.

Back in 2015, Sasikumar’s wife filed divorce alleging domestic violence and later Sasikumar too filed the separation petition. But the twist came when Sasikumar’s wife lodged a complaint against him with the Director of Animal Husbandry and Veterinary Sciences on February 18, 2020. And shockingly the very next day i.e, on February 19th, the couple were granted divorce by the Judicial Magistrate-cum-Additional Mahila Court in Salem.

Learning there was foul cry in this whole episode by his wife, Sasikumar approached the Madras High Court against his termination. Taking up the case, Justice S Vaidyanathan keenly observed the events. The suspension of Director of Animal Husbandry and Veterinary Sciences has quashed and the court ordered to re-induct Sasikumar in services within 15 days.

Well such cases do appear quite often but going by the Madras High Court’s comments, there seriously needs to be a law that can protect even husbands who probably may be the real victims in some cases. Justice should be equal for all.
