‘Lets Put An End’: Mumbai Court About Vijay Mallya Case

One of the most infamous fugitives of India, Vijay Mallya had been harbouring himself in London, where he enjoys immunity from any legal action that is being taken by the Indian authorities.

Meanwhile, the court cases against him and his company have been progressing at multiple courts in India for the last decade or so. In this connection, the Mumbai High Court has made a very interesting comment and let us have a look into the same.

This asset-recovery dispute involving fugitive Vijay Mallya and a series of banks led by the State Bank of India could be nearing the end. The Bombay High Court has asked the Enforcement Directorate to clarify whether the matter is effectively over.

The development came as the Bombay High Court referred to Mallya’s 2020 petition challenging a ruling that allowed the SBI-led consortium to use assets attached by the ED to recover unpaid dues linked to Kingfisher Airlines.

Mallya’s lawyer, senior advocate Amit Desai, told the court that the petition was filed in 2020 while settlement discussions were still underway. The matter has reached the climax now with the Mumbai High Court asking the ED if the issue is pretty much sorted so that the banks can proceed with the recovery process.

The court has asked all concerned parties to move on and end the commercial dispute one way or another. So we could essentially be witnessing a recovery procedure where the banks could be permitted to liquidate the assets of Mallya.
