Biden Revokes Trump’s Rule To Ban H4-Work-Authorization

US president Joe Biden revoked the Trump administration rule that rescinds the work authorization for H4 visa holders. H4 visa holders are spouses of H-1B visa holders.

The Office of Management and Budget and the Office of Information and Regulatory Affairs said the proposed rule “Removing H-4 Dependent Spouses from the Class of Aliens Eligible for Employment Authorisation’ was being withdrawn.

H-1B visa is a non-immigrant visa that allows US companies to employ foreign workers in specialty occupations. The H4 visa is issued by US Citizenship and Immigration Services to immediate family members of H-1B visa holders, a majority of whom are Indian IT employees.

During the Obama rule, spouses of H-1B visas got employment authorization cards and the Trump administration announced it would revoke the rule in 2017. However, the Trump administration failed to complete the process of the H-4 work authorization ban in its four-year rule and now Biden revoked Trump’s attempt.
