US: Minor Offences Now Haunting Indian Students!

The tightening of US immigration rules, particularly under the Trump era, is becoming a concern for Indian students. Indian students with minor past offences are coming under scrutiny once again. Those who were let go earlier with a warning or a fine are now facing severe immigration consequences.

Some of the students are also facing the issue of visa cancellations and immediate deportation.

For example, an Indian student in New York was caught driving a little over the speed limit two years ago. He paid a small fine and was released without being arrested. Now, out of the blue, he’s facing the threat of deportation. In reality, the case is closed legally, but the consequences are haunting now.

On the other hand, there is another student from Hyderabad who stays in Missouri. He was arrested for DUI and agreed to avoid alcohol for a year and undergo regular urine tests. Despite fulfilling all the conditions, his visa was cancelled abruptly.

Also, more than 300 student visas have already been revoked, with individuals receiving sudden notices. Unfortunately, the students were not given an opportunity for appeal or rectification. Adding to the chaos is the revival of the 1940 Alien Registration Act, which requires all foreign nationals, including those on F-1 (student) and H-1 B (work) visas, to digitally register and carry proof of their legal status at all times.

In essence, what we’re seeing is a shift from immigration policy being lenient and rehabilitative to being retroactive and punitive. Students aiming to study in the US will now need to be hyper-aware of even the most minor legal missteps.
