With US President Donald Trump firmly opposing immigration of foreigners into the country, the Department of Homeland Security is tightening the rules. In a fresh move, the DHS is pushing forward a proposal to replace the long-standing model of American student visa system that allowed international students to legally stay in the country for the ‘duration of status’ with fixed-term visas.
Till now, the ‘duration of status’ arrangement allowed the students to focus on academics without fearing the visa expiry mid-course. Henceforth, that assurance might not exist. According to the new rule, students would be bound by a strict time cap, instead of linking stay to academic enrolment.
As per the new rule, the students would be forced to renew visas even before finishing their degrees. The move has cleared White House review and will be put out for public consultation. This development could reshape the experience of more than 4.2 lakh Indian students, currently pursuing academics in the US.
At present, Indian students on F-1 visas can stay in the US can stay for the entire duration of their degree, even if it stretches beyond the standard timeline. According to the proposed system, there would be a strict expiry date would be fixed on visas which means the students need to renew their visas mid-course if their programme goes beyond the visa duration.
The new rule might affect doctoral students and those in the research-heavy fields. The delays due to thesis extensions, lab work, or unforeseen circumstances could force students to seek visa renewals, adding to the financial burden and also disrupting their studies.
It may be recalled that the proposal for fixed-term visas was pushed by the Trump administration in 2020 too with two or four year limit, but it was shelved due to opposition at that time.
Though the rule has not been finalized yet, the students can mentally prepare for its introduction by monitoring the updates from DHS and US consulates, calculating the renewal costs and timelines into financial planning, seeking academic advice to gauge the delay in the academic programmes and participate in the public comment process to raise their objections.
Now, it has to be seen if the country would remain a sought-after destination for students from other countries.
