Finally, Is It A Indirect Ban On Gutkha ?

In a major step, the Centre is now coming up with a proposed bill that will aim to ban gutkha and pan masala. The proposed bill, called the Health Security to National Security Cess Bill, 2025, will be presented by Finance Minister Nirmala Sitharaman in the coming Winter Session of Parliament next week. 

With this bill, It brings a completely new system to control how gutkha, pan masala and similar tobacco-based products are made. Instead of taxing companies based on how much they produce, the new law will put a special cess on the machines that are used for production which could cause supply chain disruptions in this case. This means the tax will depend on the capacity of the machines, not the final output. Even small hand-made units, which often work secretly without proper rules, will now have to pay a fixed monthly cess.

The main idea behind this move is simple: to collect more money for healthcare and national security as it has become major concern with how worse the health impact has been due to the tobacco consumption and seen as a healthcare threat to national security  

Now with this, the manufacturers must pay the cess every single month, no matter how much they produce. They will get relief only if a machine is shut down for more than 15 days. Every company that can be big or small should and must register with the government, file monthly returns and allow officials to inspect their units. Now, no more this unregulated business cannot be compromised and the government saved from tax evasion.  

This time, it just doesn’t stop with regulation but also high penalties are there where anyone found breaking the rules can face up to five years in jail and heavy fines. Companies can appeal against any order, even up to the Supreme Court. The government will also have the power to double the cess if needed.

Once the bill gets passed, this could be the biggest reform for the Gutkha industry and stop its overconsumption that could lead to indirect boycott and ban on these products. Recently, even BCCI  that has been running all Pan-massla and gutkha ads at the stadium which were contributing large sum of money by ad revenue and later this year, they announced a ban of these ads.
