All of India is currently looking at the election commission chief Gyanesh Kumar. This is due to the fact that the opposition parties and the cockroaches movement have started a protest against his unilateral decisions as the CEC of the country.
While there are multiple public protest happening against the election commission chief, this case has now reached the Supreme Court as well.
While hearing this case, the Supreme Court made a very interesting comment regarding the kind of legal immunity that Election commission chiefs have. It was remarked by the apex court that these election commissioners have more immunity than the judges themselves.
The Supreme Court on Monday commented that the legal protection granted to the Chief Election Commissioner and the Election Commissioners under the 2023 law may be bigger than the protection available even to constitutional court judges.
This comment was made during the hearing of petitions challenging the decisions allegedly taken unilaterally by CEC Gyanesh Kumar in connection with the SIR of electoral rolls.
The fact that the Supreme Court itself is commenting that the election commissioners have more legal freedom than judges could be an indication of what happened in the recent past.
