The President of United States, Donald J Trump is on an unreal mission of deporting illegal immigrants. In this context, the United States has already deported hundreds of Indians, and is on a mission to clear out most illegal immigrants. The government is going hard, not just against Indian population, but also global immigrants.
As if this isn’t concerning enough, the latest developments are suggesting that Trump is contemplating the idea of invoking the 1798 alien enemies act in order to speed up the deportations.
Essentially, the Alien Enemies Act of 1798 grants the President authority to detain or deport nationals of a hostile nation during times of declared war. However, the Act is activated only during formal war declarations against specific nations. Without such a declaration, its provisions cannot be invoked.
If Trump actually works this act, then there will be no provision for him to declare war in order to amplify the deportations. He can vastly amp up the process by revoking the act and the subsequent legal proceedings that come with it.
But again, invoking this act and carrying on with mass deportations have a long and demanding legal procedure, without which Trump could find himself in the middle of a legal mess. It has to be seen how the United States judiciary system will react to this decision, if at all Trump presents it in court.
