Those Are Not Porn Films: Raj Kundra Tells Court

Beleaguered businessman and husband of Bollywood actress Shilpa Shetty, Raj Kundra, who was facing charges for his alleged involvement in production of pornography, has moved the Bombay High Court. In his petition, Raj Kundra informed the court that the films – those are in question – are not ‘porn’ films. He declared to the High Court that the films portray scenes in which the characters express their feelings for love making. He claimed that the films shall not be considered as “porn” films.

He thus appealed to the Bombay High Court that his arrest as per the Information Technology Act, Section 67A is illegal.

Raj Kundra further appealed to the court that he was not given prior notices in the matter and not sought his statements which ought to be recorded first before arrest. He informed the HC that the officials have arrested him first without following the due process. He alleged his arrest was “invalid” and “illegal”.

Raj Kundra has appealed to the High Court that the lower court’s orders directing him to police custody should be revoked. He appealed to the High Court to quash the orders passed by the lower court.

Earlier on Friday, a Mumbai Court sent Kundra and his associate Ryan Thorpe to police custody till July 27 in connection with a case related to the production of pornographic films. Mumbai Police on Friday produced Raj Kundra and his associate Ryan Thorpe before Magistrate Court seeking further custody for seven days. Mumbai Police told the Court that they suspect money earned from pornography was used for online betting.

It can be noted that Raj Kundra was arrested on Monday night by Mumbai Police for allegedly creating pornographic films and publishing them through some mobile applications. The Mumbai Police on Tuesday informed that the Property Cell of its Crime Branch had so far arrested a total of 11 people, including Kundra for their alleged involvement in the crime.

“He appears to be the key conspirator. We have sufficient evidence regarding this,” Mumbai Police Commissioner Hemant Nagrale had said after Raj Kundra’s arrest. The case was registered with Crime Branch Mumbai in February 2021 about the creation of pornographic films and the use of apps.
