In another setback to the Trump government, a federal judge has ordered stopping immigration arrests based on race, ethnicity, or occupation in seven California counties, including Los Angeles. According to a report by AP, the court also ruled that immigration authorities must allow attorney access at a detention facility in LA.
A couple of days ago, a federal judge in New Hampshire had blocked Donald Trump’s executive order restricting birthright citizenship as part of a class-action lawsuit. A federal judge in New Hampshire said he will certify a class action lawsuit including all children who will be affected by U.S.
President Donald Trump’s executive order ending birthright citizenship and issue a preliminary injunction blocking it. The lawsuit was filed on behalf of a pregnant woman, two parents and their infants, challenging Trump’s January order denying citizenship to those born to parents living in the U.S. illegally or temporarily.
The temporary injunction was issued following a lawsuit by immigration advocacy groups, in which it was alleged that federal agents were being high-handed and targeting Latino communities through warrantless arrests and also denying access to the detainees. The court’s orders come amid growing concerns over immigration officials raiding car washes, parking lots, cannabis farms, and detaining people based on their appearance and language, across Southern California. The judge termed the enforcement actions unconstitutional under the Fourth and Fifth Amendments.
The judge’s order also affects Ventura County, where farm works were detained during court hearing, that led to protests. Several plaintiffs in the case filed by the American Civil Liberties Union complained that the agents were arresting people simply for looking Hispanic or for speaking Spanish. Government attorney Sean Skedzielewski however denied any racial profiling. He said immigration agents acted based on a totality of circumstances, which also included appearance but also considered previous surveillance and intelligence.
