H-1B Visa Holders
The Donald Trump administration in the United States has brought in a series of regulations and restrictions affecting the Indian community. While Trump has already begun cracking down on student visas, it is now becoming clear that certain restrictions are being enforced on H-1B visas as well.
Reportedly, multiple cases have emerged of H-1B visa holders being sent back from US airports after returning from long visits to India.
According to a US-based attorney, three to four such cases have been observed recently. Immigration authorities are reportedly sending back Indian H-1B visa holders who return to the US after extended stays in India.
The rule in question requires an employer to file an amendment if an H-1B employee travels to India for more than 60 days. Failure to do so can lead to strict action from authorities, and in some cases, the visa holder may even be sent back due to inadequate paperwork. A few such incidents have already occurred, creating panic among H-1B workers.
The key advice being given to H-1B holders now is to limit visits to India to within three weeks to avoid such problems at airports.
Experts note that this regulation regarding H-1B visas has existed for a long time, but strict enforcement has only been observed in the last few weeks.
