Indian Origin Judge Blocks Trump’s Green Card Freeze!

A major setback has hit the Trump administration’s immigration policy after an Indian origin US federal judge ruled against a controversial green card screening rule.

Judge Amit Mehta of the US District Court said the State Department cannot freeze or delay green card applications based on a broad policy that assumes applicants may depend on government benefits in the future. He ruled that such decisions must be made individually by consular officers, as required under US immigration law.

The case was filed by a Brazilian investor seeking permanent residency through the EB 5 visa program. He argued that his application was unfairly delayed because of the policy introduced by the State Department under Secretary of State Marco Rubio.

Judge Mehta agreed, saying the government had gone beyond the powers granted by Congress. He ordered officials to review the applicant’s case again on an individual basis once all required documents are complete.

The ruling is expected to benefit many green card applicants whose cases were delayed under the policy and could influence how similar immigration cases are handled in the future.
