The Telangana government has been particularly active and aggressive when it comes to the implementation of the anti drunk driving policy. This is taken up very seriously by Hyderabad police as strict regulations are in place against drivers who are intoxicated.
Until now, this standard procedure was that the police would immediately confiscate the vehicle and take it into custody if the driver is found to be intoxicated beyond legal limit.
However, the latest confirmation from the Telangana High Court is that the police will no longer have the right to confiscate the vehicle after it is caught in the drunk driving case.
The High Court pointed out that the police will have to immediately intimate family members or friends after identifying a driver in a drunken condition.
The police will no longer be legally permitted to carry the vehicle to the station, which was the standard procedure till now. They will have to immediately intimate the family members or friends of the individual in question and let them take custody of the vehicle.
However, this would be an elongated and lengthy process, and it has to be seen whether it would actually be possible practically, considering the strict time constraints during the police checks.
