High Court’s Verdict on Using Alcohol Brand Name as Film Title

Tamil hero Ravi Mohan’s upcoming film “Bro Code” lands in legal controversy as the Delhi High Court restrained the film’s production house from using the title as the registered trademark belongs to an alcohol beverage brand. The High Court ordered the banner, Ravi Mohan Studios, not to use “Bro Code” as the title of its film in any form, directly or indirectly.

The bench, headed by Justice Tejas Karia, remarked that using the title would likely cause harm to plaintiff Indospirit Beverages’ reputation, leading to the damage of consumer trust and goodwill that the company developed over the years.

The court’s statement read, “A prima facie case is made by the Plaintiff that the Plaintiff’s Mark has been used identically in the title of the Defendant’s film without any authorization from the Plaintiff, which amounts to infringement and is also likely to create confusion in the minds of the consumers of the Plaintiff’s product under the Plaintiff’s Mark.”

Meanwhile, the production house argued that the beverage company had no registration for their trademark in “Class 41” of the Trade Marks Act 1999, which deals with the restriction on assignment or transmission when exclusive rights would be created in different parts of India.”

Directed by Karthik Yogi, Bro Code features Ravi Mohan, SJ Suriyah, Arjun Ashokan, Upendra, Gouri Priya, Shraddha Srinath, Malavika Manoj and Aishwarya Raj in lead roles. It is slated for release in 2026.
