Trump’s Costly H-1B Move Triggers Legal Storm

US President Donald Trump’s controversial executive order approving a $100,000 fee for the H-1B visa on September 19 has faced its first major challenge. A coalition of healthcare providers, religious organizations, educators, and advocacy groups filed a federal lawsuit in San Francisco on Friday to halt the Trump government’s sudden imposition of a $100,000 fee for H-1B visa applications. 

The plaintiffs argued that the fee has halted hiring plans and pushed employers, workers, and federal agencies into confusion. They also argued that the sudden financial burden could jeopardize the ability of employers to fill essential roles, harming both public services and economic innovation. Todd Wolfson, president of the American Association of University Professors, said, “This new fee will drive away top global talent at a time when we need them most.” 

The H-1B visa program was designed by Congress to attract highly skilled foreign workers to fill specialized roles and is widely used by hospitals, schools, and research institutions to fill crucial positions. According to the lawsuit, about one-third of H-1B workers serve as nurses, teachers, scholars, pastors, and physicians. 

Echoing the sentiment, several industry leaders and unions argued that the fee prioritizes wealth over skill and that Trump’s plan favors the rich and connected while sidelining diligent experts. The lawsuit sought an immediate injunction to block the fee and restore stability to the H-1B application process. 

Critics of Trump’s new H-1B fee alleged that the program has been used to significantly undercut American wages, citing instances of foreign workers accepting significantly lower salaries. Tech giants like Amazon, Microsoft, and Google remain heavily reliant on H-1B visas to meet their workforce demands.
