Anti-Climax For BRS’s Defections Case!

A Supreme Court bench headed by Justice Sanjay Karol has taken up the matter of MLAs defecting from their parties in Telangana.

Senior Advocate Abhishek Singhvi, appearing for the Speaker, explained to the court that Speaker Gaddam Prasad Kumar has taken a final decision on all 10 petitions filed in this case and that the petitions have already been disposed of.

The court was told that the 10 MLAs have not changed parties. The court agreed with Singhvi’s argument and ordered the Speaker to provide copies of his verdict within 2 days. The Supreme Court later declared the hearing over.

It is a disappointment for the BRS which hoped the Court will declare the MLAs disqualified. It is anti-Climax to this case because the Speaker moved and heard the Disqualification Petitions after several harsh comments by the Apex Court. However, the Court finally agreed to what the Speaker decided.

It is an open secret that the ten MLAs elected on the BRS ticket have defected to the Congress Party.

Danam Nagender even contested for Secunderabad Lok Sabha Segment on Congress Ticket despite being a BRS MLA. He was defeated and is continuing as a BRS MLA.

Another BRS MLA Kadiyam Srihari’s daughter also contested for Lok Sabha and the veteran leader campaigned aggressively for her.

The Speaker declared both these cases as invalid and declared there is no evidence that they changed parties.

This is a shocking verdict but the Supreme Court can not do anything because it does have any hold on the proceedings of the Assembly. Only the Speaker has absolute power and even courts can not interfere.

While KTR wanted the MLAs to get disqualified, he set a future precedent with this case that nothing will happen for defections in all other states across the country.

In a way, the BRS will also accept this verdict because it cannot afford to face a by-election. We have seen most by-elections in Telangana going the Congress way. The BRS may not be ready to face an election at this moment, a political observer said.
